1. Introduction

Vicario Consulting SA, whose registered office is at Avenue de la Gare 33 in Lausanne (hereinafter referred to as “Vicario” or “we“), provides consultancy services in the field of human resources, management training and recruitment, including audits and surveys (hereinafter referred to as the “Services“). We also offer content relating to our Services on our website (www.vicario.ch) (hereinafter referred to as the “Site“).

In order to provide our Services and to provide content on our Site, we process a certain amount of personal data, in particular from employees or third party beneficiaries of our clientele or candidates (hereinafter referred to as “you“). When we refer to personal data, we are essentially referring to personal data within the meaning of the Federal Data Protection Act (DPA), i.e. any information that enables us to identify you immediately or by combining it with other information.

This privacy statement (hereinafter referred to as the “Statement“) sets out in general terms the main points relating to the processing of your personal data in our capacity as data controller. Please note that additional information and exceptions to this Declaration may apply in certain cases.

2. Processing of personal data

When you use our Services

When you, your employer or a third party company uses our Services, we may process a certain amount of personal data about you. This may include the following categories of data:

  • data relating to your identity: first name, surname, date of birth, nationality, gender, place of origin, etc. ;
  • data relating to your contact details: address, telephone number(s), e-mail address, payment details, etc. ;
  • details of your career path: your job title, training, professional experience, references, salary, etc. ;
  • data relating to your personality: your motivations, your salary expectations, the results of personality assessments or tests, particularly when the assessments or tests are carried out by service providers via us, your interests, etc.

When certain assignments require it, we may have to process certain data relating to your state of health, for example if you have a disability, or to your criminal record, for example when recruitment requires you to provide a criminal record.

If we are conducting an investigation (internal enquiry, administrative enquiry, etc.), we will also process personal data relating to the facts under investigation and potentially linked to your work history.

We process this data in order to provide our Services on behalf of our customers or to ensure the smooth running of our organisation and our activities. If you or your employer are one of our customers, or where you have otherwise given us your consent, we may process your data to provide you with information about publications, events, news, new services or products related to our business that may be of interest to you.

When you visit our Site or our pages on social networks

When you interact with us on our Site or on a social network such as Facebook or LinkedIn, or authorise such a social network to share with our accounts, we may receive and process any data you share with us. This may include basic data relating to your profile (e.g. identity, contact details, profile photo, user ID, etc.), your correspondence and any other data or activities that you share with us or that you authorise the third-party social network to share, for example when you use our contact form. The social networks on which we are present are governed by their own terms of use and confidentiality policies, for which we are not responsible. This data is processed in order to interact with you, respond to your requests or, where applicable, to improve our Services or the content of our Site.

In addition, when you browse and interact with our Site, automated data collection technologies are used to collect certain personal data to understand your actions (e.g. which links were clicked, which pages were viewed), as well as other similar data and statistics (e.g. content response times, download errors, length of time spent on certain pages, type of browser used or location of connection). This information is captured using automated technologies such as cookies. Outsourcing

We may use external service providers as subcontractors, in particular to ensure the smooth running of our organisation and activities, to provide our Services and to manage, analyse and/or maintain the Site or our IT systems. Personal data is only communicated to them to the extent necessary to carry out the tasks entrusted to them.

Communication to third parties

We may pass on your personal data to third parties (i) if this is necessary to pursue the purposes for which they were transmitted to us, (ii) if you have given your prior consent, or (iii) if we are permitted or required to do so by law (e.g. at the request of a judicial authority, to enforce our legal rights or to collect a debt with the help of a debt collection service). This will be the case in particular when we provide Benefits on behalf of your employer and this involves the transmission of your personal data.

Transfer abroad

Personal data is mainly processed in Switzerland and Europe.

If we need to use a foreign service provider located in a country that does not have an adequate level of data protection according to the competent personal data protection authorities, we will adopt the additional measures required by law before any communication of your data abroad, such as signing standard contractual data protection clauses.
